For the purposes of these Terms of Service:

  • "Customer," "You," or "Your" refers to the individual or entity accessing our Service and purchasing our products.
  • "Service" refers to our website, online store, and all related services provided by R&S Farm NC.
  • "Products" refers to the meat products, including beef, pork, poultry, and other farm products offered for sale through our Service.
  • "Website" refers to rsfarmnc.com and all associated pages.
  • "Order" refers to a request by a Customer to purchase Products from R&S Farm NC.

2. ACCEPTANCE OF TERMS

By using our Service, you confirm that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms of Service
  • You will comply with all applicable federal, state, and local laws
  • All information you provide is accurate and current

3. PRODUCTS AND SERVICES

3.1 Product Information

We strive to provide accurate descriptions, images, and information about our Products. However, we do not warrant that product descriptions, images, or other content on the Service are accurate, complete, reliable, current, or error-free.

3.2 Product Availability

All Products are subject to availability. We reserve the right to limit the quantity of Products available for purchase and to discontinue any Product at any time without notice.

3.3 Product Quality

Our Products are sourced from our farm and processed in accordance with USDA and North Carolina Department of Agriculture & Consumer Services regulations. All meat products are processed at inspected facilities to ensure food safety and quality.

3.4 Weights and Measurements

Products sold by weight are approximate. The actual weight at time of pickup may vary slightly from the listed weight. You will be charged based on the actual weight delivered.

4. ORDERING AND PAYMENT

4.1 Orders

When you place an Order through our Service, you are making an offer to purchase Products. We reserve the right to accept or reject your Order for any reason, including product availability, errors in product or pricing information, or concerns about fraud.

4.2 Order Confirmation

After placing an Order, you will receive an email confirmation. This confirmation does not constitute acceptance of your Order. Your Order is accepted when we confirm it is ready for pickup.

4.3 Payment Methods

We accept major credit cards, debit cards, and other payment methods as displayed on our website. Payment is processed at the time you place your Order.

4.4 Pricing

All prices are in U.S. Dollars and are subject to change without notice. We reserve the right to modify prices at any time, but price changes will not affect Orders already confirmed.

4.5 Taxes

Applicable sales taxes will be added to your Order total as required by North Carolina law.

5. ORDER PICKUP

5.1 Pickup Method

All orders must be picked up at our location in North Carolina. We do not offer home delivery service.

5.2 Pickup Schedule

Pickup dates and times will be coordinated when you place your order. You must pick up your order at the scheduled date and time. If you need to change your pickup time, contact us at least 24 hours in advance.

5.3 Pickup Requirements

When picking up your order, you must:

  • Arrive at the scheduled date and time
  • Present valid photo identification matching the order name
  • Bring coolers or appropriate containers to transport perishable products
  • Ensure proper transportation and storage of products immediately after pickup

5.4 Unclaimed Orders

If you do not pick up your order at the scheduled date and time and do not contact us to reschedule:

  • Your order will be held for a maximum of 24 hours
  • After 24 hours, we reserve the right to cancel your order without refund
  • Perishable products cannot be held indefinitely

5.5 Food Safety

Perishable Products must not be left at room temperature for more than two hours (or one hour if the temperature is above 90°F). You are responsible for maintaining proper food safety practices after picking up your Order. We recommend bringing coolers with ice for transportation.

6. CANCELLATIONS AND REFUNDS

6.1 Order Cancellation

Regular Orders: You may cancel your Order up to 24 hours before the scheduled pickup time. To cancel, contact us immediately at the email or phone number provided on our website.

Special Orders (Half Beef, Whole Beef, and bulk orders): Orders for half animal (Half Beef), whole animal (Whole Beef), or custom bulk orders are NOT refundable or cancellable once confirmed. These products require:

  • Special animal reservation and preparation
  • Custom processing according to your specifications
  • Coordination with our processing facilities
  • Significant resource commitment

By placing a Half Beef or Whole Beef order, you agree that the deposit and full payment are non-refundable under any circumstances, except in the event that we are unable to fulfill delivery of the product.

6.2 Refund Policy

We want you to be completely satisfied with your purchase. If you are not satisfied with the quality of our Products:

  • Contact us within 48 hours of pickup
  • Provide photos and description of the issue
  • We will work with you to resolve the issue through replacement, credit, or refund at our discretion

6.3 Non-Refundable Situations

Refunds will not be provided if:

  • You failed to properly store Products after pickup
  • You were not available for pickup at the scheduled time without prior notification
  • You changed your mind after picking up the order
  • Products were prepared, thawed, or consumed
  • The order is for Half Beef, Whole Beef, or custom bulk orders (as specified in section 6.1)
  • You did not bring adequate equipment (coolers, ice) to safely transport the products

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any errors or omissions in any content
  • Any loss or damage of any kind incurred as a result of your use of the Service

The Company's total liability to you for any claim arising from or related to the Service shall not exceed the total amount paid by you to the Company for your most recent purchase.

8. USER ACCOUNTS

8.1 Account Creation

You may be required to create an account to use certain features of our Service. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

8.2 Account Termination

Promotional codes and discounts are subject to specific terms and conditions and have expiration dates. We reserve the right to:

  • Limit the use of promotional codes
  • Refuse or cancel promotional codes if fraud is suspected

Promotional codes:

  • Cannot be combined with other offers unless explicitly stated

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16. WAIVER

Our failure to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

17. ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and R&S Farm NC regarding your use of the Service and supersede all prior agreements and understandings.
